FRTTS trial escalation at highter court
After multiple failed attempts to criminalize the popular slogan “From the River to the Sea, Palestine will be Free”, the Berlin justice system is going all out!
Normally, using the slogan is prosecuted under the “use of unconstitutional symbols” and would be handled by a local court. This time, the state is accusing the person of „distribution of propaganda material of unconstitutional and terrorist organisations”. This accusation means that the case is handled at the state’s higher court. In other words, by linking the slogan to a charge of terrorist propaganda, the state was able to escalate these proceedings and overstep the local courts!
What does that mean?
Unlike in normal court cases where an appeal means the re-examination of the case, the appeal in this case will lead immediately to the highest court in the country – the federal court. The state is using the opportunity to go after the popular slogan, so any negative decision can and will be used for all other cases of criminalising “From the River to the Sea, Palestine will be Free”.
The proceedings are already filled with irregularities:
Although the accused person had a lawyer already, the state prosecutor tried to use the lawyers time of absence to assign them a different lawyer chosen by the state.
The case is being handled by a judge with an aggressive attitude towards the Palestine solidarity movement.
Multiple court hearings with so called “experts”
After setting 10 court hearings for this case, the court is bringing new “Islam experts” to testify on the slogan, since the previous experts stated clearly that it can not be seen as “Hamas propaganda”. In other words, they are actively looking for “experts” without integrity who would support the state in its crackdown against the Palestine solidarity movement.
Beyond the technicalities of how they’re attempting to ban it, the slogan is a political statement expressing the aspiration of a liberated Palestine. A Palestine without the colony. A Palestine without Zionism. A Palestine without apartheid and genocide. And that’s exactly what they’re trying to criminalize. The mere thought of a brighter future. And they will never succeed.
